Eleggibilita’ e immunita’ parlamentare

In questi mesi si e’ parlato molto dei rapporti tra politica e magistratura, con una crescente tensione fino alla recente approvazione del provvedimento che concede l’immunita’ alle quattro piu’ alte cariche dello Stato. Questo atto legislativo non ha comunque messo fine alle discussioni, e diversi esponenti della classe politica e della magistratura hanno avanzato nuove proposte, facendo spesso riferimento all’immunita’ parlamentare.

Per questo motivo, ho pensato di presentare qui le mie idee per un atto legislativo che possa essere equilibrato tra le posizioni dei giustizialisti e dei garantisti e cercare di mettere un freno alle annose polemiche. Sono conscio che con questo post scatenero’ discussioni, spero costruttive e non offensive, ma spero che il mio contributo possa essere utile alla discussione.

1) Non e’ eleggibile alle Camere e non puo’ essere nominato ministro chi e’ stato condannato con sentenza definitiva al momento della presentazione delle liste elettorali; 2) e’ candidabile chi ha procedimenti in corso, ma decadra’ automaticamente in caso di sentenza definitiva di condanna; 3) per i parlamentari eletti e’ previsto il ripristino dell’immunita’ e dell’autorizzazione a procedere per dibattimenti che dovessero sopravvenire dopo l’avvenuta elezione; 4) in caso di mancata autorizzazione a procedere da parte delle Camere, la posizione del parlamentare interessato verra’ stralciata ed il processo riprendera’ alla fine del mandato, bloccando i termini di eventuale prescrizione; 5) per una lista di reati piu’ gravi di natura penale, l’autorita’ giudiziaria puo’ procedere senza dover richiedere autorizzazione alle Camere.

The Council of Europe on Italian Immigration Policy

The Council of Europe has published a Memorandum on Italian immigration policy, highlighting that ”Immigration policy must be based on human rights principles and not only on perceived security concerns” (commissioner Hammarberg). The full report can be found at this page.

1.000 !!!

Dear all,

One thousand is a great number. One thousand visits in few months is a great result for a blog that is not updated daily and that often deals with personal themes…When I opened the homepage today and saw thouse four digits, I felt full of emotion and started looking at all the post I have published since I created this corner and thinking at all the many things that have happened in my life in these months…Love, friendship, studies, politics, sport, etc.: several kinds of events, stories and feelings have characterised this period of my life and in these days I have been thinking a lot, even if I wrote very rarely here…

There are some moments in life when it is necessary to stop, find some time for oneself and think. For me this is one of that moment, in which I am trying to understand if what I have done till now is what I expected from my life, if I am satisfied from my current situation, if the perception that I have of myself is more or less similar to what people think of me and so on…In a bit more than one month this first here in Brighton will be over, so thoughts about the past and the present mix with ideas, expectations, concerns about the future: my family, the people I have met here, my PhD, etc…

It is a huge flux of images, sounds and words that goes around my mind: concentrating is so difficult these days and I feel lost sometimes, confuse about where I am in this moment of my life trip…it is not easy, but…that’s life! Every time I wake up I find out something new, some times nice, other times bad…things and people around me change, my mood and body change…but I am still there, with my soul, my heart, my mind, with my qualities and my limitations, trying to play the most difficult and most exciting game we have on earth, that is living…

And here I will keep you updated about me, about my life, about my thoughts, hoping that this one thousand can be the beginning of a long story, whose plot I still don’t know…

Volere bene…

It’s not easy to translate volere bene in English: it’s a
combination of “to care”, “to be fond of”, “to love”, and we use it a
lot in friendships and relationships….What does it mean volere bene a
someone? I don’t know exactly! Maybe it means to be distracted and
think of her during the day, or to dream her during the night, or to
wait all the time for a message or a call from her, and then that
message changes your day, making you feel happier or sadder…or again
it means to enjoy at fullest the time spent together, or to smile and
cry when you think at her, or to rejoice and suffer with her and
because of her…So I can’t say for sure, but maybe volere bene a
someone means all these things together and many more, that make you
become part of that person or that person a part of you!
